The present general conditions of sale are agreed, on the one hand, by the Société Comptoir Français de la Chemise SA, whose capital is Euros 352,992 and whose headquarters is 30, avenue Franklin-D-Roosevelt, 75008 Paris, registered in the Commercial Register of Paris Companies under the number 552 095 234, known as ‘Alain Figaret’, and, on the other hand, by any non-trading physical person desiring to proceed with the purchase of an item presented on the marketing site of "Alain Figaret", known as the customer.

PURPOSE
The present general conditions of sale aim to define the rights and obligations of the parties in the context of the sale of items proposed on the marketing site by ALAIN FIGARET to the customer.

The acquisition of an item by means of the present marketing site implies the unconditional acceptance by the customer of the present conditions of sale which are valid, binding and governed by French law.

These conditions of sale shall take precedence over all other general or particular conditions not expressly agreed to by ALAIN FIGARET.

ITEMS
Items offered on the "Alain Figaret" marketing site constitute a selection of those which are presented in the "Alain Figaret" shops.
The customer who wishes to avail himself or herself of a broader choice is invited to visit the "Alain Figaret" shops.
The items on the "Alain Figaret" marketing site are presented with the greatest precision in order to fulfil the provisions of article L 111-1 of the consumer code which stipulates the necessity for the customer to be aware before the final order of the essential characteristics of the items (sizes, composition, etc.) which he or she wishes to purchase.
If, in spite of all the care taken by "Alain Figaret", there are inaccuracies in the presentation on this site, "Alain Figaret" shall in no event incur any liability therefor.
Photographs illustrating the items for sale are not included within the scope of the contract. They have solely an indicative value given the alterations that may occur as a result of their uploading onto the site.

PRICES
Prices are firm and final. They are expressed in Euros including all taxes in the summary of the order. The VAT corresponds to the Value Added Tax in effect on French territory, namely 19.6%.
For all deliveries outside the European Union and the French Overseas Departments and Territories, sales prices are expressed in Euros not including tax in the summary of the order.
"Alain Figaret" reserves the right to modify prices at any time, without notice and without any other formality except to incorporate the said modifications into the General Conditions of On-Line Sale, but items ordered are invoiced at the price in effect on the day of the order.
Thus, if the VAT rate were to change, the price of items might be modified.
The prices of "Alain Figaret" items are expressed excluding transport costs, i.e., excluding the expense of preparation, freight, insurance and customs clearance of parcels.
These transport costs are invoiced in addition, and indicated on the summary of the order before its final approval by the customer.
The amount of transport costs is calculated as a function of the country of destination and the actual weight or volume of the parcel in accordance with the methods defined by the shipper chosen by "Alain Figaret".

 ORDER
A guided search allows the customer to find a selection of items from the "Alain Figaret" collection on the "Alain Figaret" marketing site and then to make his or her choice from this selection in order to place his or her order.
This customer order is carried out in three steps:
1-The first step consists of the approval ― by the customer ― of the articles chosen for his or her order.
"Alain Figaret" guarantees that the items proposed at the time of the order are actually available; in addition to avoid two simultaneous orders for the same item, "Alain Figaret" verifies, at the time of the approval of the order, the precise availability of the items chosen and sets them aside.
2-The second step consists of the entry by the customer of the necessary pieces of identification and other information required for the execution of the order, namely, in particular, the following items: surname, forename, complete delivery address information, billing address.
To that end, the customer shall be required to create an ‘account’ identified by his or her e-mail address and a password which his or her will need to choose.
If the customer has already ordered from the "Alain Figaret" site, these pieces of identification and other information will have been saved; he or she will then need to call up his or her account (by inputting his or her e-mail address and his or her password); once connected to his or her account, the customer may, if necessary, modify his or her information.
3-The third step consists of the final approval of the order.
The customer is presented with a summary of his or her order ― valid and binding as a purchase order ― including all items selected, delivery and billing addresses, the total amount of the said items and transport costs.
At this point, the customer verifies the summary of the order and carries out, if desired, any modifications to it. After such modifications, he or she will be presented with a new summary of his or her order so modified.
Any order whether modified or not must receive final approval on the part of the customer, based on the summary described. This action is effected by clicking on the ‘confirm’ button, and that constitutes the first click.
The customer is then presented with the General Conditions applicable to the sale of items presented on the marketing site in order that the customer may become acquainted with and/or print them.
The customer will then need to accept the terms of the said General Conditions. This acceptance will be carried out by clicking on the ‘accept’ button, and that constitutes the second click.
These two clicks constitute an electronic signature that has, between the parties, the same validity as a handwritten name, in accordance with article 1316-1 of the Civil Code.
Following this latter click, the customer is directed to the secure site of the partner bank of "Alain Figaret" to effect payment.
Immediately upon receipt by "Alain Figaret" of the approval which its partner bank will notify to it, the customer order will be confirmed by e-mail which shall be valid and binding acceptance of the contract.
"Alain Figaret" commits to preparing the order in the shortest possible time. The customer will be advised of despatch of the order via e-mail.

PAYMENT
Payment, expressed exclusively in Euros, shall be made exclusively on line on the secure site of the partner bank of "Alain Figaret".
Payment is made by CB bank card. Cards with the insignia CB, branded as Visa, Eurocard, MasterCard, as well as the cards American Express Card France, Diners Club and all others approved by CB GIE are accepted.
If payment is made by Visa, Eurocard MasterCard, the customer must provide his or her card number, its expiry date and the security code (the last three figures written on the back of the bank card).
If payment is made by American Express Card France, Diners Club, the customer must provide the number of the card as well as its expiry date.
The customer’s bank account is debited at the departure of the delivery for the price in Euros expressed on the date of the order.
In order to ensure security of payments, the "Alain Figaret" site uses a secure payment service for remote item sale provided by Crédit Mutuel, partner bank.
This service integrates the secure socket layer (SSL) technology which ensures, through an encryption (encoding) technique, the entire confidentiality of the data (bank card number, expiry date and security code) in transit via the Internet.
In order to verify the identity of the customer and the billing address of the order, some customers might be contacted by FIA-NET, the partner of the “Alain Figaret” site who is specialised in the control of online fraudulent cases, for further supporting documents and papers.  For further information about FIA-NET, please visit their site at www.fia-net.com. 
For deliveries outside the Euro zone, customs, foreign-exchange and other banking fees shall remain for the exclusive account of the customer.
For further information, "Alain Figaret" invites the customer to enquire with the bank that issued the bank card used for payment or the relevant customs services concerning customs duties.

PROOF OF ORDER AND OF PAYMENT
"Alain Figaret" invites you to print your purchase order which will be useful in the event of a reimbursement.
The information technology files, held in the information technology systems of the company COLT Télécommunication shall be considered as proof of orders and of payments effected between the parties.
The archiving of purchase orders is carried out by a reliable and lasting support system which can be produced as proof.

DELIVERY
Items are delivered by Chronopost or any other shipper chosen by "Alain Figaret" in an average observed time of 5 business days in metropolitan France (including Corsica) and an average time of 10 business days outside metropolitan France, depending on the destination country.
These times are provided as an indication only. Exceeding these times shall in no event be held against "Alain Figaret" nor give rise to any cancellation of the contract or to any indemnity whatsoever for damages and interest.
Shirts for delivery are methodically accompanied by a care and maintenance booklet in their packaging which provides useful information to the customer.
Items are always shipped at the risk of the customer, who must check their good condition at delivery.
Any problem concerning delivery (damaged parcels, items missing from to the "Alain Figaret" invoice accompanying them, etc.) must be mentioned on the delivery receipt presented by the shipper.
The customer must equally confirm this problem by sending to the shipper within the 7 days following the delivery date a registered letter with return reply requested describing the said claims, which must be justified and accompanied by the relevant documents.
The customer must transmit in the same period of 7 days following the delivery date a copy of that letter to "Alain Figaret" at the following address: comptoir français de la chemise ― on-line sales service - alain figaret, 89 chemin de la Ronde, 78290 Croissy-sur-Seine, France.

RIGHT OF REVOCATION
In accordance with the provisions of article L. 121-20 of the consumer code, the customer is entitled to a period of 7 calendar days from the delivery date to exercise his or her right of return and cancellation of his or her order.
The date of the delivery receipt constitutes the starting date of this period. This right of return and cancellation may concern all or part of the order.
For that purpose it is sufficient to return these items with the invoice in their original condition and packaging, to the following address: comptoir français de la chemise ― on-line sales service - alain figaret, 89 chemin de la Ronde, 78290 Croissy-sur-Seine, France.
Shipping costs of items returned to "Alain Figaret" and, if applicable, customs duties shall remain the responsibility of the customer, except if the delivered items do not match the order or display obvious defects.
The reimbursement, including the shipping charges debited, shall be credited to the customer’s bank account as soon as possible and at the latest 30 days following the date on which the right of revocation has been exercised by the customer in accordance with article L. 121-20 of the consumer code.  The reimbursed amount will be credited to the customer's bank account, or upon request of the customer, via other form of payment proposed by a professional service provider.  In no event shall reimbursement be requested or made in one of the "Alain Figaret" shops.

LIABILITY
"Alain Figaret", in the process of on-line selling, shall be liable only as a user and shall incur no liability for any damage resulting from the utilisation of the Internet such as hacking, a software virus, interruption of service or more generally all instances characterised as force majeure by the courts.

INTELLECTUAL PROPERTY
All elements of the "Alain Figaret" marketing site are and shall remain the exclusive intellectual property of "Alain Figaret".
No person is authorised to reproduce, utilise, broadcast or make use of, for any purpose whatsoever, even in part, the elements of the site whether visual or audio.
Any direct link or hyperlink is strictly prohibited without the express agreement of "Alain Figaret". Any link must be withdrawn upon simple request by "Alain Figaret".

NOMENCLATURE DATA
In accordance with the law concerning information processing, files and freedoms of 6 January 1978, nomenclature information concerning customers may be processed automatically.
This processing is required in order to process customer orders. By indicating his or her e-mail, the customer may receive confirmation of his or her order but also information on "Alain Figaret" promotions as well as on events via Internet and in the shops.
"Alain Figaret" reserves the right to collect information concerning customers including by use of cookies and if it desires to transmit the information so collected to business partners.
The customer may object to disclosure of his or her personal information by so informing "Alain Figaret" via e-mail at the following address: shoponline@alain-figaret.fr or by post to the following address: comptoir français de la chemise ― on-line sales service - alain figaret, 89 chemin de la Ronde, 78290 Croissy-sur-Seine, France.
In the same way, the customer has a right of access, modification and rectification of personal data about himself or herself, in accordance with the law of 6 January 1978. This right may be exercised via e-mail or by post to the addresses indicated hereinabove.
A declaration concerning automatic data processing, including the management of e-mail addresses of the user of the site, has been made to the CNIL [Commission nationale de l’informatique et des libertés ― French National Commission for Information Technology and Freedoms] under registration number 1 133 840.

SETTLEMENTS OF DISPUTES
The present conditions of on-line sale shall be governed by French law.
In the event of a dispute, jurisdiction shall be vested in the courts of jurisdiction of the headquarters of the Société Comptoir Français de la Chemise SA notwithstanding plurality of defendants or introduction of third parties.
